US Judge Orders Freedom of Abrego Garcia from ICE Custody
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.
"Since his release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The case originates in a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an mistake. After his repatriation to the United States to answer human smuggling allegations, he was detained in immigration detention.
In her order, the judge pointed out that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
